Mediation, also frequently referred to as a Settlement Conference, is a legal proceeding where the parties present their case to a neutral attorney, known as the mediator. The mediator is usually an experienced personal injury attorney. Sometimes Mediation, or a Settlement Conference, is required by the courts prior to the parties presenting their case.
In general, Mediation is an informal process where the mediator attempts to help the parties reach an agreeable settlement based upon the strengths and weaknesses of the case. After reviewing the facts and the positions of the parties, the mediator opens negotiations between the parties. As part of the mediation, the mediator acts as the go between for the parties in their settlement negotiations. If he or she believes the offers made are reasonable, the mediator will try to push the parties toward settlement.
